To follow posts and access a specific profile, the user must choose the "follow" option, becoming a follower. Virus: Malicious software that infects systems and computers, aiming to cause damage, makes copies of itself and tries to spread to other computers using various means.
3. SERVICES
3.1. Sorteio.com consists of, but is not limited to, a Platform that offers services to assist and optimize giveaways conducted on social networks. Additionally, it aims to be a tool for achieving better results for your business on social media.
3.2. Sorteio.com facilitates conducting giveaways on Instagram. The Platform will search the User's profile posts, and the User indicates which post is designated for the giveaway. After designating the post for the giveaway, the Platform fetches all comments made on the post. After the search, the giveaway is conducted by randomly selecting one of the comments on the post that meets the giveaway conditions.
3.3. Thus, by using Sorteio.com, the User understands and accepts that all their actions and choices are free and have no influence or interference from Sorteio.com. All information provided on the Platform, as well as on Instagram, is also their own exclusive responsibility.
3.3.1. The User understands and accepts that the responsibility for all content generated on their social media profile is exclusively theirs. Furthermore, Sorteio.com has no connection with Instagram.
3.3.2. We recommend that Users read Instagram's Terms of Use and Privacy Policies.
3.4. Sorteio.com offers giveaways in free and VIP Loading modes.
3.5. To load for free, the User must have fewer than 100 comments on the post, download the Sorteio.com browser extension and/or connect with Facebook.
3.6. Without the extension and Facebook connection, it is not possible to draw for free, even if the post has fewer than 100 comments. In this case, the option for VIP Loading will appear for the User.
3.7. VIP Loading does not require connecting with Facebook or downloading the extension, but connecting with Facebook will make loading faster.
3.8. To conduct giveaways with posts that have more than 100 comments, the User must use VIP Loading and make the corresponding payment.
3.9. After making the VIP Loading payment, the User has up to 7 (seven) calendar days to conduct that giveaway.
3.10. The VIP Loading payment is for a single post. If there are multiple giveaway posts, the User will need to pay for multiple VIP Loadings.
3.11. With VIP Loading, instabilities may occur as it is a process that depends on Instagram, over which we have no control.
3.12. With VIP Loading, the User can close the Sorteio.com page and the loading will continue (in the cloud). However, with free loading, this will not happen, as closing Sorteio.com will cancel the loading.
3.13. It is clarified that this service does not establish between the parties any employment, corporate, or associative relationship, with each party remaining solely responsible for all their respective expenses and charges, whether of a labor, social security, tax, insurance, civil, criminal, or any other nature.

4. USER REGISTRATION
4.1. For User registration and use of services on the Sorteio.com Platform, the following information will be required: Instagram username and email address.
4.1.1. To facilitate registration, the User may also log in by granting the Platform access to their Instagram account. Sorteio.com will only access the User's public profile data.
4.2. Each User will determine their login and access password, and it is their exclusive responsibility to maintain the confidentiality of this information. Sorteio.com is not responsible for actions and damages that may be caused by unauthorized access to the account by third parties.
4.3. Sorteio.com may refuse, suspend, or cancel without prior notice a User's access account whenever it suspects that the information provided is false, incomplete, outdated, or inaccurate, or in the cases indicated in applicable laws and regulations, these Terms and Conditions of Use, or any Policy.
5. PLATFORM GRATUITY
5.1. The User shall not pay fees to use the Platform's services. However, to use the VIP Loading option, the User must pay a fee for this feature. These amounts will always be displayed before you make the purchase.
5.1.1. To load for free, the User must have fewer than 100 comments on the post, download the Sorteio.com browser extension and/or connect with Facebook.
5.2. Cancellation of Sorteio.com Services
5.2.1. To cancel services and request deletion of the access account, the User must send an email to contato@sorteio.com or use the contact form available on the website sorteio.com.
5.2.2. To learn what we do with personal data processed during the Platform usage journey, access our Privacy Policies.
5.3. Refund Policies: To ensure your satisfaction, Sorteio.com has established a Refund Policy. This section sets forth the rules and conditions for refunds regarding the purchase of the VIP Loading option. Refunds may be issued on the following occasions, after a situational analysis by Sorteio.com:
5.3.1. Giveaway not completed due to technical problems:
5.3.1.1. Technical problems not caused by the User, considered system errors. In the case of a refund request, the platform will conduct an analysis regarding the reported technical problems and then, if the request is approved, the User is notified through the same channel where the support was initiated.
5.3.2. Delay in VIP Loading release.
5.3.2.1. A delay is considered any VIP Loading that is not released within 1 (one) hour after payment.
5.3.3. After the User makes the VIP payment, the loading of comments from their giveaway post begins. The platform provides the estimated timeframe until loading is completed. This timeframe may be longer depending on the number of comments. Therefore, a refund may be requested if the informed timeframe is exceeded by more than 50% (fifty percent) of the estimated value.
5.3.4. Duplicate Payment:
5.3.4.1. If for any reason two or more payments are made for the same giveaway post, they will be refunded; simply make the request through one of our support channels.
5.3.5. How to request:

5.3.6. Timeframe: The refund is made to the bank account (PIX) or credit card that the User used at the time of purchasing the VIP Loading. If payment was made via credit card, the timeframe to receive the amount will follow the conditions imposed by the Card Operator. For payments made via PIX, the refund will occur within 48 (forty-eight) hours after the customer has had their request analyzed and confirmed by the Support team. Refund receipts must be requested at the time the User receives the refund confirmation message.

6.1.3. Communicate any changes to services to Users through simple notices on the Platform;
6.2. User's Responsibilities:
6.2.1. Use the Platform according to the usage criteria defined by Sorteio.com, without altering its programming, breaking passwords, or performing procedures that may cause harm to other Users;
6.2.2. Be responsible for all purposes, including legal ones, for the content of information entered on social networks, as well as the Platform;
6.2.3. Fully respect these Terms of Use, Privacy Policies, current legislation, and contracts between the parties.
6.2.4. Be responsible for the content, products, or services advertised, as well as the frequency of posts.
6.2.5. For the entire preparation of the giveaway, including legalization before regulatory bodies (SECAP, Caixa, etc.).
6.2.6. Be responsible for the delivery of products, services, prizes, and related items resulting from the giveaway conducted.
7. LIMITATIONS OF LIABILITY OF Sorteio.com
7.1. Sorteio.com is not responsible for:
7.1.1. Any unavailability of the Platform that it did not cause.
7.1.2. Damages that the User may experience due to exclusive actions of third parties, as well as network connection failures and malicious interactions such as viruses.
7.1.3. Damages that the User may have as a result of misuse of the Platform in non-compliance with these Terms, the Privacy Policy, the law, or court orders.
7.1.4. Any penalties that the User may receive for misuse or violation of Instagram's Terms and Conditions.
7.1.5. Force majeure or unforeseen circumstances.
7.1.6. Content posted, services/products advertised or sold, as well as the quality of any material presented by Content Provider Users on Instagram.
8. RULES OF CONDUCT AND PROHIBITIONS
8.1. Content Provider Users may not:
8.1.1. Harm the rights of Sorteio.com, its Users, or third parties, or act by any means or form that may contribute to such violation;
8.1.2. Incorporate viruses or other elements that may damage or prevent the normal functioning of the network, system, or computer equipment of Sorteio.com or third parties, compromise security, limit, or prevent the use of the Platform;
8.1.3. Use the tool to engage in illegal actions, attempt or carry out attacks on the Sorteio.com server;
8.1.4. Enter data that is false, outdated, or incomplete, or publish or transmit any content that is not true or that has no authorization to do so;
8.1.5. Unlawfully access, add, subtract, or modify the content of the Sorteio.com Platform;
8.1.6. Impersonate any other person or entity;
8.1.7. Break the Platform's security, inspect the page to extract codes, content, and participant comments;
8.1.8. Reproduce, duplicate, copy, or resell any part of the Platform in violation of the provisions of these terms of use;
8.1.9. Resell access to the Platform;
8.1.10. Frame the Platform or any part of it;
8.1.11. Copy any material obtained from the Platform to peer-to-peer networks or other websites or web services;
8.1.12. Access without authority, interfere with, damage, or interrupt any part of the Platform, any equipment or network on which the Platform is stored, any software used in providing the Platform, or any equipment or network or software owned or used by third parties.
8.2. At the sign of any breach of conduct, the Content Provider User may be blocked or removed from the Platform without prior notice.
6.1. Sorteio.com's Responsibilities:

6.1.2. Be responsible for the Platform's operation and for any corrections that may be necessary;
6.1.3. Communicate any changes to services to Users through simple notices on the Platform;
6.2. User's Responsibilities:
6.2.1. Use the Platform according to the usage criteria defined by Sorteio.com, without altering its programming, breaking passwords, or performing procedures that may cause harm to other Users;
6.2.2. Be responsible for all purposes, including legal ones, for the content of information entered on social networks, as well as the Platform;
6.2.3. Fully respect these Terms of Use, Privacy Policies, current legislation, and contracts between the parties.
6.2.4. Be responsible for the content, products, or services advertised, as well as the frequency of posts.
6.2.5. For the entire preparation of the giveaway, including legalization before regulatory bodies (SECAP, Caixa, etc.).

8.1.3. Use the tool to engage in illegal actions, attempt or carry out attacks on the Sorteio.com server;
8.1.4. Enter data that is false, outdated, or incomplete, or publish or transmit any content that is not true or that has no authorization to do so;
8.1.5. Unlawfully access, add, subtract, or modify the content of the Sorteio.com Platform;

9. INTELLECTUAL PROPERTY
9.1. The ownership and rights related to the Sorteio.com Platform belong exclusively to Sorteio.com. Access to the Platform and its regular use by the User do not grant them any right or prerogative over intellectual property or other content included therein.
9.2. All Platform content, including name, brand, domain, programs, databases, files, texts, designs, photos, layouts, headers, and other elements, was created, developed, and assigned to Sorteio.com, and is therefore the exclusive property of Sorteio.com or licensed to it, and is protected by Brazilian laws and international treaties on intellectual property rights.
9.3. The following are prohibited: exploitation, assignment, imitation, copying, plagiarism, reverse engineering, hacking attempts, storage, alteration, modification of characteristics, expansion, sale, rental, donation, alienation, transfer, reproduction, in whole or in part, of any content from the Sorteio.com Platform.
9.4. Any person who violates the prohibitions contained in intellectual property legislation and these Terms shall be held civilly and criminally liable for the infractions committed, in addition to being subject to penalties on the Platform.
